Terms of Service

Our services
Nexens provides design, development, and digital strategy services to clients on a project or retainer basis. The specific scope, timeline, and deliverables for each engagement are defined in a separate proposal or statement of work agreed upon before work begins. These terms govern the broader relationship between Nexens and any client or visitor to this site.
Payment
Project fees are outlined in the agreed proposal. We typically require a deposit before work begins, with the remainder due on completion or at milestones defined in the proposal. Invoices are due within 14 days of issue. Work may pause on overdue accounts. We reserve the right to charge interest on invoices outstanding beyond 30 days.
Intellectual property
Upon receipt of full payment, all custom work produced for you becomes yours. Until then, all work remains the property of Nexens. We retain the right to display completed work in our portfolio unless you request otherwise in writing. Any third-party assets, fonts, or libraries used in your project remain subject to their respective licences.
Revisions and scope
Each project includes a defined number of revision rounds as stated in the proposal. Work requested outside the agreed scope will be quoted and invoiced separately. We will always flag scope changes before acting on them - you will never be surprised by an unexpected invoice.
Limitation of liability
Nexens is not liable for any indirect, incidental, or consequential damages arising from our work or your use of deliverables. Our total liability in any circumstance is limited to the fees paid for the specific project in question. We do our best work on every engagement - but we cannot guarantee specific business outcomes.
Termination
Either party may end an engagement with written notice. If you cancel a project in progress, you are responsible for fees covering work completed to that point. If we cancel due to circumstances on our end, we will refund any fees paid for work not yet delivered.
Changes to these terms
We may update these terms from time to time. The current version is always available on this page. Continued use of our services after an update constitutes acceptance of the revised terms.
